Video Contest Rules
How to Enter:
To enter The Molly Lake Chronicles Video Contest (the “Contest”), you must do the following:
1. Submit your Entrance Form via mail and postmarked no later than September 15, 2012, to Samuel Endicott, Post Office Box 1412, Hampton, Virginia 23661.
2. Submit your video on Compact Disc via mail and postmarked no later than October 31, 2012, to Samuel Endicott, Post Office Box 1412, Hampton, Virginia 23661.
Agreement to Video Contest Rules:
Submission of an Entry Form constitutes your full and unconditional agreement to and acceptance of these Video Contest Rules and the decisions of the Sponsor, which are final and binding. Failure to comply with these Video Contest Rules could result in the disqualification of your entry.
Entrant Eligibility:
The Contest is open to everyone around the world except for the following individuals:
1. Paid staff, consultants and the immediate family (siblings, spouses, children and parents) of the Sponsor.
2. Anyone living in a place where local or U.S. law prohibits this type of competition.
Note: Video-makers of any age may submit entries, but if you under 18 years of age, your parent or guardian must sign and submit the Entrance Form on your behalf.
Video Requirements:
Submitted videos must meet all of the following requirements or they will be disqualified.
1. Content:
a. Your video must film a scene from either The Molly Lake Chronicles Book 1 The Triangles of Quebec or The Molly Lake Chronicles Book 2 Barely Afloat (the “Molly Lake Books”).
b. The first ten (10) seconds of your video must display a sign with the following information:
i. The title of the book which contains the scene you are filming
ii. The author’s name, Samuel Endicott
iii. The pages of the book which your filmed scene covers and
iv. A title for your filmed scene
c. The characters in your video must use exact dialog from the book scene you are filming. For example, if you are filming a scene where Peter says in the book, “I’ll deliver it tomorrow.” The video should also have Peter saying “I’ll deliver it tomorrow.” If the exact book dialog is not followed, your video may be subject to disqualification.
2. Length: The video may be no longer than the maximum length that can be uploaded and shown on YouTube, which is currently fifteen (15) minutes.
3. Language: Dialog and/or title cards must be in English.
Sponsor:
The Contest is sponsored by the author of The Molly Lake Chronicles Books, Samuel Endicott.
Prizes:
First Place: $3,000.00
Second Place: $1,500.00
Third Place: $ 750.00
Fourth Place: $ 500.00
Selection and Notification of Winners:
The judging of the submitted videos and selection of the winning videos shall be made by the Sponsor in his sole discretion based upon how well an entry video portrays the novel and its characters with additional consideration for props and costumes. The Sponsor reserves the right to hire additional persons to view the video entries in the event that the number of entries is larger than anticipated, and the Sponsor accordingly makes no guarantee that he will personally review every video. The winning videos shall be announced by publication of a list of winners on www.samuelendicott.com on or before November 30, 2012. Prize payments will be mailed to the address provided on the winning entrants’ entry forms on or before December 5, 2012.
Model Releases:
You must have a written release from each person who appears in your video and whose face can be identified. (That is, you do not need to obtain releases for unidentifiable people in a crowd.) If a person is a minor (under the age of 18), the minor’s parent or guardian must sign the release for them.
Copyright Representations and Indemnification:
If you use any material owned or copyrighted by someone else, aside from the material in the Molly Lake Books, you must have written permission to use that material and to grant the Sponsor the license granted in the Rights to Entries section below. Owned and copyrighted material includes, but is not limited to, music, artwork and photographs. By participating in the Contest, you represent and warrant that you have the legal authority and right to convey the license granted in the Rights to Entries section below, and you agree to defend, indemnify and hold the Sponsor harmless from and against, any claim, loss, demand, liability, obligation and expenses (including reasonable attorneys’ fees) resulting from the use of the submitted video including but not limited to, any personal or bodily injury or property damage arising out of, pertaining to or resulting in any way from, the use or possession of the submitted video.
Rights to Entries:
By submitting your entry video, you grant to the Sponsor a perpetual, unlimited, non-exclusive license to use your video. The Sponsor may grant, transfer or assign this license to a third party.
Additional Conditions:
In the event that the security or administration of the Contest is impaired in any way or unable to run for any reason, including but not limited to fraud, unauthorized human intervention, technical problems such as video difficulties, or acts of God, as determined by Sponsor in his sole discretion, then the Sponsor may in his sole discretion either (a) suspend the Contest to address the impairment and resume the Contest in a manner that best conforms to the spirit of these Video Contest Rules or (b) terminate the Contest and, in the event of termination, award the prizes at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in his sole discretion to disqualify any individual he finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Video Contest Rules or in an unsportsmanlike or disruptive manner. In the event of any attempt by any person to undermine the legitimate operation of the Contest, the Sponsor reserves the right to seek damages (including attorneys’ fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Video Contest Rules shall not constitute a waiver of that provision.
General Release of Liability:
By participating in the Contest, you agree to release and hold harmless the Sponsor from and against any claim, loss, demand, liability, obligation or expense (including attorneys’ fees) arising out of the participation in the Contest or the receipt or use of a prize, including, but not limited to: (a) any technical errors associated with the Contest, including a failed recording of the Entry Video onto the submitted compact disc; (b) unauthorized human intervention in the Contest; (c) lost, damaged, delayed, postage-due or misdirected entries; (d) any other errors or problems in connection with the administration, postponement or cancellation (if any) of the Contest, or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Contest, including in connection with the filming of your video, or from your acceptance, receipt or misuse of a prize. You further agree that in any cause of action, the Sponsor’s liability will be limited to the cost of entering and participating in the Contest, and in no event shall you be entitled to receive attorneys’ fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Disputes:
Any and all issues, disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Commonwealth of Virginia, and shall be governed by, and construed in accordance with, the laws of Virginia, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Virginia.
